RTI appeal in reference 8EJFIPX3.
In the above reference, the PIO has denied providing the information on the grounds that the information sought was in the form of a query/clarification.
- The PIO has erred in denying the information on the grounds that it was sought in the form of a query/clarification.
- As per Section 2 (f) of the RTI Act, "information" includes any material in any form.
- The PIO has a statutory obligation to provide information if it is held by the public authority "irrespective of whether the same is sought in the form of a query."
- The PIO's decision is in violation of the provisions of the RTI Act which mandates that citizens have a right to access information held by public authorities.
In view of the above, the Appellate Authority is requested to:
- Direct the PIO to provide the information sought.
- Take necessary action to ensure that the PIO is aware of and complies with the provisions of the RTI Act in future.
